Law Personal Statement
I am a person keen on challenges. Law will provide me with the kind of constant challenge I have always craved, while helping me to improve my analytical, practical & communication skills. Also my concern and curiosity about society and its people inspired me to pursue this subject for my higher education, as I believe Law plays an essential role in the changing nature of society.
My upbringing has honed my perception of society and people leading me to be acutely aware of social injustice, inequality, exploitation, discrimination, and religious fundamentalism, especially in a society such as the one I come from - Bangladesh. I possess a desire, to struggle if necessary through my life in establishing a society which will be free from exploitation and inequality. As such, I have chosen to study Law, for I believe the proper implementation of Law is the only potent weapon to obliterate injustice. I believe throughout the history of the world, working classes have been deceived by the upper class bourgeoisie and the elites - my ultimate goal in life is to establish the rights of the socially deprived classes. I always have wondered why Law has not been used to raise the voice of the working class, and why it has been used to safeguard the interests of people who are exploiting. I seek a new dinition of human rights – the true dinition, without exploitation and corruption colouring the notion. My greatest wonder is why our society and the legal system, do not point out economic exploitation as an abuse of human rights; for it is the root of poverty, which elicits crime. If the creation of Law is to curb injustice, why has it not been used to eradicate this injustice? Taking law as a subject for higher education will hopully help me find answers to my questions, and will teach me the proper method of implementation.
I am someone who is passionate to evaluate problems. I am not an extremist but I do not hesitate to resort to radical measures if the situation forces it. I believe, in a society, co-operation is more desired than competition; competition doesn’t necessarily bring rapid prosperity. I adhere to a socialistic political ideology, and aim to devote myself in establishing true socialism. I am from a country, which has been subject to military dictatorship for over twenty years after her independence. My political consciousness grew during the time, when my father was imprisoned by the military just because he was a leader of a political party who opposed military regime. Police and military jointly ran a brutal campaign throughout the country to repress politicians, where they imprisoned and sometimes killed thousands of students, politicians, professionals, workers, and even soldiers. These incidents severely affected my family, making my childhood a turbulent time. After the military regime failed, a western style democratic political structure was set up, which gave nothing, yet increased the discontent of the masses, and created some elites, who virtually control the country. Wealth and power both are centralized to them, law is a puppet in their hand, and they control everything, from economy to politics. Millions of people live below the poverty level, and there is nobody, not one strong and resilient political party to represent them. Extreme form of capitalism has taken over our country’s social and human values, and morality is at the brink of extinction. Corruption is everywhere, human rights abuses are innumerable, political repression is paramount, money is power and power is everything. This indisciplined violent condition of my country created a rebellious nature within me that is why I have set my ambition to restructure the socio-political structure of my country in a radical way. I would like to utilize the knowledge I acquire from my life at university and beyond to clarify and show me the proper way of implementation of my thoughts.
I have proved myself as an ficient and responsible student through primary and secondary school, I have been able to maintain and improve my grades, which are consistently good. Currently I am undertaking A’ levels in History, Government & Politics, and Bengali. Being an ambitious and inquisitive person, even after completing a Foundation Programme with an overall A grade, I have chosen to do three A’ levels in one year to study in one of the top British universities. History has always fascinated me; though this is the first time I am studying this subject in detail. In Government & Politics, I am learning about the procedures of law making and the system of politics and government in different countries. Languages have always been of interest to me, and my favoured loyalty is to my mother tongue - Bengali.
I have spent my time productively on extra curricular activities. I have keenly taken part in debating, student politics and acting in television dramas. I headed my school’s debating society for one year and independently achieved many prizes in speech competitions at local and national levels. My hobbies include reading, playing cricket and table tennis, web browsing, etc.
The principal reason for my desire to study at UK is the quality of teaching here and particularly in my chosen subject, Law. I also find exciting the prospect of joining a university hee with international flavours and exceptional research facilities. I believe University is a place for accumulating more interests, for meeting people, for working hard, for finding a niche in life. I feel I have the commitment and confidence of giving my best during my university career and afterwards
I know a man with confidence might not win, while a man without confidence must lose. I am person with confidence that is from solid foundation. My confidence and solid foundation have helped me make great days by gone. I will prove this with the following parts.
My foundation is intelligence, diligence, industriousness and serious study attitude, which are essential to a person who wants to be successful. As a young child, I got many competition certificates and got high scores in all kinds of mental test. I like thinking, especially logical illation, which supplies me a lot of fun. When I was seventeen, I watched a Hong Kong soap opera, in which a lawyer’s wonderful rebutment and precise illation made deep impression on me. From then on, I aimed to be an excellent lawyer. In order to realize my dream, I enrich my self by reading and thinking every day. I am eager to meet problems to enjoy the study process and the gladness brought by the settlement of problems. In my “mind dictionary”, there is no “mission impossible”, because my slogan is also “impossible is nothing”.
With my intelligence and diligence, I was registered in China University of xxx, the most famous and professional law university in China. At university, I further improved my research ability and practice ability. I spent three years completing all the courses which are supposed to be finished in four years, with overall GPA 3.6. Moreover, I got scholarship every year. I prepared TOFEL in my spare time and got high marks—650. According to what I have learned and thought, I wrote two papers this year, both published in national level magazine. In the papers, I separately discussed the necessity and moderation of self-dence in international law, and the legal features and nature of International Factoring. (I have translated these two papers into English and sent them together with other application materials. I hope they will be helpful for you to know more about my academic ability) What benited me most were not the papers but the process of writing. I earnestly dealt with each step, from consulting materials, fixing thesis, composition to how to clearly express my views and how to logically dissertate. I incessantly modified and polished them. Finally, the result proved me right—I was not only praised by my supervisor but also had the opportunity to publish them.
I actively participated in all kinds of academic communication activities organized by our university. Last summer, I stood out in strict written and oral examinations and took part in summer school held by xx College of xx University, as a representative of our university. Owning to my outstanding study performance, I got scholarship supplied by xx College. During one month of study, I realized the differences between Common Law and Civil Law as well as similarities. I patiently read cases, seriously listened to professors’ classes and attended seminars. In the end of program, I finished two papers about contract law and completed my courses successfully. This study experience makes me believe that I am able to acclimate myself to foreign study and living environment, which strengthens my confidence to study in the United States.
Besides study, I attach attention to practice. In my opinion, law is not only for learning, but also for use and the purpose of learning law is to use it. Therore, I cherish every opportunity to have internship. I followed my tutor to consulted materials, arranged cases, took part in the session and contacted parties in law firms and courts. In these internships, I experienced the work of a lawyer and judge; learned their strong work ability and responsible attitude; applied what I had learned into practice. From these experiences, I practiced my ability to use law as well as strengthened my understanding of theory. With solid coursework and serious attitude, I was praised many times in work units.
In order to improve my comprehensive ability, I took part in many social activities. I was hostess in TV station at our university and took charge of editing and scheming programs. During this time, I was graded as “excellent TV reporter” and “best hostess”. I once worked in public relations department of Students Union and succeeded in soliciting sponsorship many times; organized students to attend court hearings in local court; organized students to propagandize law and supply legal service for free; I also worked as a translator in University Foreign Affairs Office and translated a lot of materials about communication between our university and foreign universities. What’s more, I was champion in our province in Spoken English Contest held by Ministry of Education and Ministry of Culture…All these activities make me a person with outstanding performance in many respects besides study.
As the development of intercourse between China and foreign countries, we need more and more lawyers who are able to deal international cases in China. However, we extremely lack of this kind of persons. Therore, I hope to be an excellent lawyer who is adept at dealing with cases involving in China and western countries, which is also where my interest lies in. Chinese leader Chairman Mao once said, “If you want to know the flavor of pear, you must taste it by yourself.” I believe that to study western law in foreign countries is a fatal step for me to realize my dream. I am sure I am able to take this step well. I would be honored if I can study in your renowned university, this is quite important for my life planning and aim. Maybe at the moment I am not the best among the students who apply to your university, but I have enough intelligence, perseverance, confidence, potentials and improvement space, which are the reasons for you to select me. Law constantly changes to rlect the present time in our society, and it is the corner stone of any civilization. Unlike many other developed countries, China’s legal system is still in its infancy stage. As such, the practice of law presents a huge challenge as many cases are first impressions to test the limit of the old and newly promulgated laws and regulations. As someone who is eager for taking on this challenge, I found Law Department of your university to be the ideal place to sharpen the tools needed to pursue a career in Law.
Born in an intellectual family, I was encouraged by parents to read more books in my young age and I showed a natural talent for learning and was blessed with a strong memory. After National College Entrance Examination, with the excellent record I was accepted by xx University Law School. The solid and comprehensive coursework that I did for my program covered almost all fields of jurisprudence, including Constitutional Law, Legal Theory, Civil Law, Commercial Law, Finance Law, and Public and Private International Law etc.. However, my sole weakness lies in the fact of low GPA during the early part of my college career. There are two reasons I think I can demonstrate. One is, during the first two years, I may be too immature to care about scores. The other one is, I enjoyed working for community and had interns in quite a few companies, which took me a large amount of time in practicing and working and these two factors did affect my academic performance. One cannot change what has happened in the past and can only move on while cherishing the experience we derive from our mistakes. In some ways, I am glad that I made the mistake of not earning higher marks in the early part of my college years, and such mistake motivated me and taught me not to repeat the same in the future.
I believe that the law is not always black or white and that it rlects and can be influenced by history, culture, political and economic situations, and the overall environment of the international community. Therore, when analyzing a legal phenomenon or certain clauses of law, I am used to taking various factors into consideration to analyze and get more reasonable and comprehensive understanding. However, I couldn’t be clearer that the real meaning of law lies in practices and thus took every chance to accumulate abundant first-hand experience in undertaking legal matters during the undergraduate period. I took part in No. 2 Reconnaissance Section, Anticorruption Bureau, People’s Procuratorate of xxx, Compliance Bureau xx Court, xxx Law Firm and xx xx Law Firm. I saw this experience as the first taste of my future legal career. My work at Law Firm exposed me to some of the realities of law such as the legal atmosphere, the commitment and initiative required, and the diversity and complexity of the job itself. Whether doing investigation, correcting dictation, or watching the lawyer in court, I was glad to have participated in the legal process. Meanwhile, this experience made me realize that injustice and suffering in the world are too widespread to be solved only by someone or a certain group of people. Only by attacking the roots of these problems can I play a more substantial role in the dense of denseless victims and thus get more involved in it.
The deeper I delved into the legal field, the more dects I found in the existing legal system of China. In my opinion, a current legal problem facing China is the judicial corruption and injustices. China’s existing judicial system, established under the conventional framework, is increasingly failing to facilitate the development of the market economy and the formation of a society ruled by law. Judicial injustices have constituted the most serious obstacle that are seriously endangering China’s social and economic programs, jeopardizing social stability and resulting in the general public’s skepticism, distrust and even contempt for the authority of law. China’s accession into the WTO, a drastic event which marks China’s determination to conform to international practices, has further rendered the existing judicial system obsolescent. The system of market economy, which China is assiduously trying to establish, will be inconceivable without a sound judicial system. In view of those above, it’s necessary for us to study and to learn from the “Rule-by-Law” concepts and experiences in western countries. It also requires the rational guidance, strong advocacy and brave trailblazing on the part of judicial professionals represented by jurists, lawyers and judges. It can thus be concluded that judicial rorm is the key of the keys to the construction of China as a “Rule-by-Law” country.
In order to prect Chinese law, one must learn advanced law and way of thinking from the west. Though there are many limitations of Chinese legal system, they also show that China legal has a great developmental potential. After completing my LLM at your institution, where I will have the opportunity to enjoy a renowned faculty, and a wide range of course offerings, I would like to become an excellent international lawyer back home, apply the advanced legal knowledge and particularly way of thinking that I have learned in the United States to China, and make my contributions to Chinese legal rorm.
To live a meaningful life everyday; to continually pursue my predetermined worthwhile goals. -My view of life.
Could I put myself in the life-threatening working environment? Could I sacrifice my life for the benits of others? Some people may laugh at my crazy question. To me, that is a serious question I have come a long way to find my answer. “I am not sure whether it is worth to answer”; “What is the true meaning of that question?”
When I was a young child, I watched a soap opera that was about court. I was deeply impressed by the judge’s calmness and the lawyer’s eloquence and resource that were showed in this opera. From then on, I hoped to study law some day. Fortunately, I performed well in entrance examination and got enrolled into xx University. Then I chose law as my major without hesitation. At university, I studied hard and got GPA 3.4. What’s more, I broadly read all kinds of books, including philosophy, history etc. My teachers’ instruction strengthened my understanding of law and makes me understand the significance of law to a country. From my studies, I had a lot of fun and got more interested in law. Moreover, I actively participated in practice in holidays from common company to law firm and tried to apply the theory I had learned into practice.
This summer, I had my internship in counselor department in xxx Group Co Ltd which was involved in a business contract dispute, which was submitted to China International Economic and Trade Arbitration Commission for arbitration. As a representative of the requested applicant, I took part in the evidence collection in the early arbitration stage and clearly explained why the 5% balance of goods was not paid on time. After knowing the whole case, I visited my teacher, an Arbitration Law professor, and listened to her opinions. Realizing the counterpart didn’t completely implement their contract duty, I gave reasons as follows: First, the counterpart company didn’t mention bearing issue, which caused that the delivered machines couldn’t be put into the plant because of the disqualification of workshop. Thus overhaul was necessary, which delayed production and resulted loss. Based on these reasons, the counterpart didn’t completely carry out its duty, so our party did not pay the balance on time. During this time, I found out the evidence and pictures that attested counterpart did not give reasonable suggestion and service, and made a statement in the court. Finally, the arbitration turned out that counterpart compensated our loss, in which the arbiters invoked the reasons that I stated. They had a panel made up of 3 lawyers and 5 company representatives as agents while we just had 3 persons—two lawyers and me. Under such condition, I was able to cooperate with them and clearly stated my opinions without any nervousness, which got their respect. This matter greatly inspired my enthusiasm on study.
In addition, I took part in the contact draft in several companies. In the process, when I met a lot of problems, I often turned to my teachers for help, which made good impression on them. As I cherished each practice, I studied my specialty and English hard. With fective study method and diligence, I did well both in English and law, which helped me a lot to get scholarship every year. On the other hand, my practice inspired me to study. In practice, I exercised my legal knowledge. I also realize the big gap between theory and its application—sometimes I have master the rules but I didn’t know how to use it in actual case. My practice experiences have not only strengthened what I learned but have supplied new knowledge for me, which is good for my future study and career.
In my study and practice, I admired outstanding lawyers’ eloquence and jumping thinking more and more. However, in China, most of lawyers come from theory study and those who can perform well in practice are insufficient. Moreover, after the China’s entrance to WTO, there are a lot of problems with Chinese law. I think, my internship experience is not enough. In practice, I could combine substantive law with procedural law to analyze case, but I still feel my theoretical foundation is not solid enough. What’s more, comparably speaking, the chances that I have to initiatively study and practice are not a lot. Thereby, I am eager to study further abroad to know more about foreign law, thoughts and lawyer career so that I am able to stand out in fierce competition.
