The first step in applying to a University is to determine your course of study and what school you would like to attend. After you are accepted to the University you will receive an I-20 from that University, only then can you plan to apply for your visa. That section requires all applicants to overcome the presumption of immigrant intent. One can overcome the presumption of immigrant intent by showing substantial ties to your country and demonstrating legitimate business travel. If you have been rused once, and if you feel you were not able to convey your substantial ties and legitimate business travel, be very prepared for your next interview. If you don t succeed this time, remember a rusal is temporary and in the future as you develop more ties to your country you may become eligible.

桑德拉 拉巴奇: Student still must overcome the presumption of immigrant intent, however, we also look to the school you are going to, your qualifications as a viable student, and your ability to pay or fund the intended education. I don't think changing your jobs 3 times in 2 years will greatly change your chances of obtaining a visa. Just be honest with the visa officer, if you try and omit something on your visa application, it is considered misrepresentation and will dinitely impact your chances of getting a visa.

Your job, your family, your assets, etc. Next, think of what you have to substantiate the reasons you would come home after a temporary visit to the US. How do you substantiate your job, your family, your bank accounts, your stocks, your animals, etc.? Bring in everything you have and be ready to explain your situation.

toysrez: My name is Qina and I came to US about 10 years ago (J1) and married to an US citizen about 7 years ago and now I am green card holder. I live in New York city with my husband and we both have stable jobs (about 80k annual gross income). Both of my parents (age 54 and 53) are in China and my dad owns his business and my mom work as an accounting manager in a mid size company. My dad came to US 3 times for the past 8 years for business and pleasure. His visa got rused once which was the time he and mom applied together. My mom applied the visa for 3 times and got rused for 3 times. I supported (i-134) last time but also got rused. We do not know why she got rused whenever she apply for the visa since my parents have ties in China and it would be very hard for them to stay in the US. I am thinking for my mom to apply the visa again in May cause I just want her to come here relex for 2 weeks. We do not know what exactly why she got rused everytime and what should we repair. I only know was when last time the officer asked her what kind visa did your daughter had to enter the US and she said i m not sure, i think student (actually i m exchange student and had a J1 visa). so we were thinking was that the problem she got rused last time because she didnt give the officer the currect answer? or because I had J1 visa bore and even I have greencard now, my mom still cant qualify? 桑德拉 拉巴奇: We see a lot of parents come in for visas to visit their children. A couple of things all parents should be able to explain is their child's status in the US and what they are doing in the US. We always ask for copies of the visa, green card, or passport of the child and usually ask for pictures of the parents with their children to substantiate relationship. If you provide the copies of your immigration status, make sure they are legible. Parents also must overcome 214B explained above. They must provide proof of their ties to China and that they intend to return after a temporary visit. Good luck to your parents.

On the I 20, the No.6, the English proficiency wrote that The student is not yet proficient, English instructions will be given at the school . 桑德拉 拉巴奇: If your TOEFL is over 600, I imagine your English is very good. Just be prepared to explain your intended study plan. Additionally, be prepared to show your ties to China, ability to fund the education, and the acceptance letter with the I-20.

Now I am going to complete my undergraduate study soon and I am admitted in a PhD Program by a US university. My question is that, will that rejection affect my coming application for F-1 visa? Should I indicate that rejection in my application form?


桑德拉 拉巴奇: Never Omit anything on your visa form. If you omit something, the officer will assume misrepresentation and it will put your whole application at risk. Your prior rusal was 4 years ago and is not likely to have a strong impact on your current application. In addition to showing your ties, I-20, and ability to pay, I recommend you provide your transcripts from your undergraduate program. Good luck.

桑德拉 拉巴奇: Once you enter the US on an F-1 visa, as long as you are in good standing in your academic program your visa status is considered current. If you return home, you will need to apply to renew your F-1 while in China. When reapplying, make your appointment for as soon as you come back to China and allow sufficient time for processing.

桑德拉 拉巴奇: Congratulations on your acceptance to the PHD programs. Every student applying for study in the US must explain why they are choosing the program they are choosing. Be prepared to share with the officer exactly what you have just shared with me. Be prepared to show your papers, publications, and any other certifications you have received. Always be prepared for possible extra administrative processing by applying early and bringing a detailed resume to the interview. Lastly, don't forget you must also demonstrate your ties to China, and your ability to fund your education. Good luck!

桑德拉 拉巴奇: Your rusal 4 years ago should not hold great weight in determining your eligibility for a graduate student visa. Be sure to prepare your undergraduate transcripts, proof of ties to China, and acceptance letter and I-20 from your University. Additionally, be ready to explain how you will fund your education and your intended course of study. Although the visa is good for one year, as long as you are in good standing at the University you will be in lawful student status. If you return to China during the course of your studies and apply to renew your F-1 visa, please bring your transcripts to demonstrate your continued studies. In regards to when to apply, you may apply up to 120 days bore the start of your program. However, you can only enter the US 30 days bore the program begins.
